U.S. Patent & Trademark Office Registration Of Internet Domain Names By Michael Kroll, Registered Patent Attorney


With the possible implementation of 7 additional top level domain names and the possible further creation of new top level domains, it is more important than ever to obtain Federal Trademark protection of a domain name in order to protect a valuable asset. The 7 new proposed top level domains are: Obtaining a trademark will help in preventing others from using the same or very similar domain name, if for example they simply try to substitute .firm for .com.

Additionally, it will help to prevent confusion and dilution of a valuable domain name. The interplay between domain names and Federal Trademarks is in its infancy and the governing law is not as clear as it will be in a few years.

Accordingly, to insure that proper Federal Trademark protection was obtained, all five of the above were registered as US Trademarks.

It is submitted that the most important and possibly the only necessary trademark is "Invention", but since there are diverse opinions as to which ones should be registered, all five were obtained.
